Welcome to Zoomy. These Terms of Service ("Terms") govern your access to and use of the Zoomy mobile application and related services (the "Service"), provided by Zoomy ("Zoomy," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use Zoomy. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. Zoomy is not directed to, and should not be used by, anyone under 18.
2. Your Account
You are responsible for providing accurate information when creating your account and your pet's profile, and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at dev@tdp-labs.com if you suspect unauthorized use of your account.
3. The Service
Zoomy helps dog owners track walks, log their pet's health information, discover nearby dogs and owners for play dates, organize meetups, and connect with other users. Features may include GPS-based walk tracking, location-based discovery, in-app messaging, a points and rewards system, and tools for storing pet health records such as vaccinations, medications, and veterinarian information. We may add, change, or remove features at any time.
4. Location Services
Many features rely on access to your device's location, including walk tracking and nearby playdate discovery. You can control location permissions in your device settings, but disabling location access will limit or disable certain features. You are solely responsible for your safety and your pet's safety while using location-based features, including when meeting other users in person.
5. In-Person Meetups and User Conduct
Zoomy may connect you with other users for walks, play dates, and meetups in the real world. We do not run background checks on users and cannot guarantee the conduct, identity, or intentions of any other user or their pet. You agree to exercise caution, meet in public places, and use your own judgment when interacting with other users or their animals. You agree not to use the Service to harass, threaten, defraud, or endanger any person or animal, post false or misleading information about yourself or your pet, or engage in unlawful conduct.
6. Health and Medical Information
Zoomy lets you store vaccination records, medication schedules, and veterinarian contact information for your own personal recordkeeping. This information is provided by you, is not verified by Zoomy, and is not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a licensed veterinarian regarding your pet's health. Zoomy is not responsible for the accuracy of any health information entered into the Service.
7. User Content
You retain ownership of the photos, bios, messages, and other content you submit to Zoomy ("User Content"). By submitting User Content, you grant Zoomy a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as necessary to operate the Service (for example, showing your pet's public profile photo to other users). You represent that you have the rights necessary to share any User Content you submit.
8. Points and Rewards
Zoomy may award points for activities such as completing walks or earning achievements, redeemable for in-app rewards, discounts, or other items at our discretion. Points have no cash value, cannot be transferred or exchanged for cash, and may be modified, suspended, or removed at any time without notice or liability.
9. Acceptable Use, Objectionable Content, and Abusive Users
You agree not to: (a) impersonate any person or entity; (b) upload content that is unlawful, abusive, defamatory, or that infringes another's rights; (c) use the Service to stalk, harass, or harm another user or their pet; (d) reverse-engineer, scrape, or interfere with the Service; or (e) use the Service for commercial purposes without our prior written consent. We may suspend or terminate your account for violating these Terms.
There is zero tolerance for objectionable content or abusive behavior on Zoomy. Objectionable content includes anything pornographic, sexually explicit, violent, graphic, hateful, discriminatory, harassing, defamatory, deceptive, or unlawful, as well as content that does not depict a pet or that endangers an animal.
You can report content from any pup's card or profile: press and hold the card, or open the profile and tap the ⋯ button, then choose Report. You can block an account from the same menu — a blocked account disappears from your Discover feed, the leaderboard, and your pack. You can unblock later under Settings → Privacy & Safety.
We review reports and act on them, typically within 24 hours, by removing content and suspending or terminating the accounts of users who violate these Terms. To reach us directly, email dev@tdp-labs.com.
10. Third-Party Services
The Service relies on third-party providers, including Firebase (Google) for authentication, data storage, and analytics, and Apple's platform services. Your use of the Service is also subject to the terms and policies of those providers where applicable.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT LOCATION DATA WILL ALWAYS BE ACCURATE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZOOMY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY IN-PERSON INTERACTION, MEETUP, OR PLAY DATE ARRANGED THROUGH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
13. Indemnification
You agree to indemnify and hold Zoomy harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or any interaction with another user or animal arranged through the Service.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the Service and delete your account at any time through the app's account settings.
15. Governing Law
These Terms are governed by the laws of the United States of America, without regard to its conflict-of-laws principles, except where prohibited by applicable local law.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
